How long after a road traffic accident can you claim?

Introduction
If you've been injured in a road traffic accident, one of the most common questions people ask is:
"How long do I have to make a claim?"
As a personal injury solicitor based in Bolton and serving clients across Wigan, Stockport, Oldham and Greater Manchester, I get asked this all the time — and the answer is important.
The Standard Time Limit: 3 Years
In most road traffic accident claims, you have three years from the date of the accident to start a claim.
This is known as the limitation period. After this time, your claim may be "time-barred" — which means you lose your legal right to compensation.
Exceptions to the Rule
There are a few important exceptions where the time limit is different:
✅ Children (Under 18)
The three-year clock doesn’t start ticking until their 18th birthday
A parent or guardian can still bring a claim before they turn 18 as their Litigation Friend
✅ Mental Capacity
If someone lacks mental capacity to manage their own legal affairs, the three-year limit does not apply unless they regain capacity
✅ Hit-and-Run or Uninsured Drivers
These can still be claimed through the Motor Insurers’ Bureau (MIB)
Time limits can still apply, so it's best to get legal advice quickly
Why You Shouldn't Wait
Even though you technically have three years, the sooner you act, the better:
Witnesses are easier to contact
Evidence like dashcam footage or CCTV is more likely to be available
Your recovery and treatment can be properly documented from the start
